These Terms of Service (“Terms”) govern your access to and use of CivicClear’s websites, applications, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Services.
1. About CivicClear
CivicClear provides digital infrastructure that enables governments and public agencies to manage civic enforcement, administrative cases, and related payment workflows more efficiently and transparently.
CivicClear is a technology provider. We do not create laws, issue citations, determine penalties, adjudicate disputes, or make enforcement decisions. All enforcement actions are taken solely by the applicable public agency under its lawful authority.
2. Eligibility and Authority
You may use the Services only if:
You are at least 18 years old (or the age of majority in your jurisdiction), and
You have the legal authority to agree to these Terms
If you are using CivicClear on behalf of a government entity, organization, or agency, you represent that you are authorized to bind that entity to these Terms.
3. Scope of the Services
The Services may include:
Civic case and enforcement management tools
Administrative dashboards and reporting
Payment initiation and recording functionality
Notifications, reminders, and status updates
Public-facing portals for case resolution
Availability of features may vary depending on the jurisdiction, agency configuration, and applicable laws.
4. User Responsibilities
a. General Conduct
You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
You may not:
Misuse or interfere with the Services
Attempt to gain unauthorized access to systems or data
Circumvent security or authentication measures
Use the Services for fraudulent or deceptive purposes
b. Accuracy of Information
You are responsible for ensuring that any information you provide through the Services is accurate and up to date. CivicClear is not responsible for consequences arising from inaccurate or incomplete information submitted by users.
5. Civic Enforcement and Payments
a. Enforcement Authority
All enforcement actions, fines, penalties, and resolutions are determined by the relevant public agency. CivicClear does not:
Decide whether a violation occurred
Set fine amounts or deadlines
Grant waivers, dismissals, or legal relief
Questions regarding enforcement decisions must be directed to the issuing agency.
b. Payments
Payments made through the Services are processed by third-party payment processors. CivicClear does not store full payment card details and does not guarantee payment processor availability or performance.
Payment confirmation reflects successful submission to the processor, not final settlement.
6. AI and Automated Features
CivicClear may use automation and artificial intelligence to support administrative workflows, including:
Case organization and routing
Reminder generation
System monitoring and anomaly detection
AI features assist operational efficiency and do not replace human judgment or legal decision-making.
7. Intellectual Property
All content, software, designs, trademarks, and technology used in the Services are owned by or licensed to CivicClear and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable right to use the Services solely for their intended purpose. No rights are granted beyond those expressly stated.
8. Data and Privacy
Your use of the Services is subject to CivicClear’s Privacy Policy, which explains how information is collected, used, and protected.
When CivicClear processes data on behalf of a public agency, it acts as a service provider or data processor, consistent with applicable law.
9. Service Availability and Changes
CivicClear strives to provide reliable access to the Services but does not guarantee uninterrupted or error-free operation.
We may:
Modify or update the Services
Add or remove features
Suspend access for maintenance, security, or legal reasons
We are not liable for disruptions caused by maintenance, third-party services, or events beyond our reasonable control.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIVICCLEAR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CIVICCLEAR DOES NOT WARRANT THAT THE SERVICES WILL MEET ALL REQUIREMENTS OR THAT RESULTS WILL BE ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIVICCLEAR SHALL NOT BE LIABLE FOR:
INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
LOSS OF DATA, REVENUE, OR USE
DAMAGES ARISING FROM ENFORCEMENT DECISIONS MADE BY PUBLIC AGENCIES
ACTIONS OR OMISSIONS OF THIRD-PARTY PAYMENT PROCESSORS
CIVICCLEAR’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID TO CIVICCLEAR FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, IF ANY.
12. Indemnification
You agree to indemnify and hold harmless CivicClear from claims arising out of:
Your misuse of the Services
Your violation of these Terms
Your violation of applicable laws or regulations
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of [Insert State, e.g., New York or Delaware], without regard to conflict-of-law principles.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.
